Terms of Service

Effective March 2026

These Terms of Service ("Terms") govern your access to and use of Foundry, the suite of AI-powered tools available at usefoundry.io, operated by Raleigh Design Co, LLC, a Wyoming limited liability company ("Foundry," "we," "us," or "our").

By creating an account or using any Foundry tool, you agree to these Terms. If you do not agree, do not use Foundry.

1. Accounts

To access most Foundry tools, you must create an account with a valid email address. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. Notify us immediately at hello@usefoundry.io if you suspect unauthorized use.

You must be at least 18 years old to create an account. By registering, you represent that you meet this requirement.

2. Acceptable use

You may use Foundry for lawful purposes only. You agree not to:

  • — Use Foundry to generate content that is illegal, harmful, harassing, defamatory, or that infringes on third-party rights
  • — Attempt to reverse-engineer, scrape, or extract Foundry's underlying models, prompts, or system instructions
  • — Use Foundry to send spam or unsolicited communications
  • — Attempt to gain unauthorized access to any part of the service or its infrastructure
  • — Resell or sublicense access to Foundry without our prior written consent

We reserve the right to terminate accounts that violate these terms, at our sole discretion, without prior notice.

3. AI-generated outputs

Foundry's tools use AI to generate copy, briefs, audits, and other content outputs. These outputs are provided for informational and creative purposes only.

We make no representations that outputs are accurate, complete, or suitable for any particular purpose. AI outputs are not professional advice of any kind — legal, financial, medical, or otherwise. You are solely responsible for how you use, publish, or act on any content generated through Foundry.

4. Subscriptions and billing

Foundry offers free and paid subscription plans. Paid plans are billed on a recurring monthly or annual basis through Stripe. Prices are displayed at the time of purchase and may be updated with notice.

By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel. All charges are in US dollars.

5. Cancellation and refunds

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period. We do not provide refunds for partial billing periods, except where required by applicable law.

If you believe a charge was made in error, contact us at hello@usefoundry.io within 30 days of the charge.

6. Intellectual property

Outputs. You own the content you create using Foundry's tools, subject to any rights held by third parties in the inputs you provide.

Our property. Foundry's interface, design, underlying code, and system prompts are owned by Raleigh Design Co, LLC. Nothing in these Terms transfers ownership of Foundry's intellectual property to you.

Your content. By submitting inputs to Foundry's tools, you grant us a limited license to process that content solely to deliver the service to you. We do not claim ownership of your inputs and do not use them to train AI models.

7. Disclaimer of warranties

Foundry is provided "as is" and "as available" without warranty of any kind. We expressly disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or free of harmful components.

8. Limitation of liability

To the maximum extent permitted by law, Raleigh Design Co, LLC and its members, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use Foundry.

Our total liability to you for any claim arising from these Terms or your use of Foundry will not exceed the greater of (a) the total fees you paid to us in the twelve months preceding the claim or (b) one hundred US dollars ($100).

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for certain damages. In such jurisdictions, our liability is limited to the fullest extent permitted by law.

9. Indemnification

You agree to indemnify and hold harmless Raleigh Design Co, LLC and its members, employees, and agents from any claims, damages, and expenses (including reasonable attorneys' fees) arising from your use of Foundry, your violation of these Terms, or your violation of any third-party rights.

10. Changes to the service

We reserve the right to modify, suspend, or discontinue any part of Foundry at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the service.

11. Changes to these Terms

We may update these Terms at any time. If we make material changes, we will notify you by email or in-product notice at least 14 days before the changes take effect. Continued use of Foundry after that date constitutes acceptance of the updated Terms.

12. Governing law and disputes

These Terms are governed by the laws of the State of Wyoming, without regard to its conflict-of-law provisions.

Any dispute arising from these Terms or your use of Foundry will be resolved through binding individual arbitration in accordance with the American Arbitration Association's Consumer Arbitration Rules. You waive any right to participate in a class action lawsuit or class-wide arbitration.
